In a heated legal dispute, tech magnate Elon Musk has reportedly managed to avoid multiple attempts by process servers to serve him child custody papers.

The mother of Musk’s three children, Canadian singer and artist Grimes (Claire Boucher), initiated a lawsuit in late September seeking physical custody of their children. However, according to court documents obtained by Insider, Musk has successfully evaded service at least a dozen times in just one week.

Grimes filed a “petition to establish parental relationship” on September 29 in a California court. Between October 13 and October 20, Grimes hired four individuals to serve Musk at various locations associated with his professional endeavors. These locations included the X headquarters in San Francisco, the SpaceX launch site in Boca Chica, Texas, and his Tesla gigafactory in Austin. They also visited several addresses linked to Musk, including a local horse farm. However, all of these attempts to serve him were unsuccessful, with one process server even resorting to tracking Musk’s private jets in a bid to locate him.

The legal battle between Musk and Grimes began with both parties filing lawsuits against each other in September. Grimes submitted her “petition to establish parental relationship” on September 29, a common step in cases where unmarried parents seek child support or custody. Musk, on the other hand, initiated legal proceedings on September 7.

In her filing, Grimes expressed her objection to Musk having custody of their three-year-old son, X Æ A-Xii.

Grimes’ attempts to serve Musk during October faced resistance, with two process servers even attempting to reach him at the home of Shivon Zilis, a director at Musk’s Neuralink startup and the mother of two of his children. They were, however, informed by someone who claimed not to know Musk.

While trying to serve the papers, process servers encountered security guards and a police officer who instructed them to leave the Tesla factory and X offices. Grimes argued that Musk was properly served as her complaint was left with the security guards.

Musk’s legal team disputed this, contending that Grimes should have persisted in trying to serve him. They also asserted that Musk was served on October 20 through substitute service, where the papers were delivered to Musk’s employees.

With a total of 11 children from three different mothers, Musk’s personal life has been the subject of considerable media attention. As the legal proceedings continue, Grimes remains resolute in her pursuit to establish parental rights and regain custody of their children.
