Sean “Diddy” Combs is not going down without a fight. The music and business mogul, who has been behind bars at Brooklyn’s Metropolitan Detention Center since his arrest in September, is making a bold move to have his sex trafficking and racketeering charges thrown out.
Diddy’s legal team is accusing federal prosecutors of crossing the line, claiming they violated his constitutional rights by seizing and reviewing privileged legal documents during an October 28 jail cell sweep. In a recent motion filed by his lawyers via AllHipHop, including Alexandra A.E. Shapiro, they argue that this alleged misconduct has compromised his ability to defend himself.
The motion slams prosecutors for viewing what Diddy’s team says were handwritten legal notes protected by attorney-client privilege. Shapiro is calling on U.S. District Judge Arun Subramanian to take action, either by dismissing the indictment entirely or disqualifying any prosecutors involved in the alleged breach.
“This kind of overreach undermines the fairness of the legal process,” the filing states, adding that the seizure of these documents could have “irreparably harmed” Diddy’s defense.
The Bureau of Prisons, which conducted the sweep, claims it was part of a broader effort to curb contraband like illicit drugs, weapons, and unauthorized electronics within the facility. Prosecutors have maintained that the operation wasn’t specifically targeting Diddy.
However, his legal team is demanding additional remedies, including appointing a Special Master to review privileged materials, suppressing the notes seized during the search, and ensuring no further monitoring of Diddy’s communications with his attorneys.
